terms of service

User Agreement

• Upon commissioning me, you as the client, acknowledge and agree to my ToS.
• Any violations to the terms will result in immediate termination of the commission and refunds will not be made.
• The client must not claim the commissioned work as their own.GENERAL
• Clients must first send inquiries to me about the commission.
• The client must provide a character reference sheet prior to the commission.
• If the client doesn’t have a character reference sheet, you have to make a separate commission to me or another artist for the character design.
• The commission’s work process may be streamed or be shared on my social media.
• The client can request for confidentiality, if the client does not want me to share the work progress of the commission publicly until release.COPYRIGHT
• I retain the right to display the commission in my portfolio.
• The commission must be credited to me accordingly, by the client.
• The commission is for personal use only.
• Clients are PROHIBITED to transfer, re-sell, or make changes to the commissioned work unless commercial rights are bought and/or approved by me.
• If the client wants to sell merchandise using the commission or show in any company or establishment, clients must buy the commercial rights to the commission.

COMMISSIONS

PAYMENT
• Only accepting currency pricing in USD$ via Paypal, Wise or GCash, and you as the client, will handle any currency conversions.
• The prices offered for the service are the base pricing.
• The prices offered may vary upon complexity. Price negotiation can be considered by me.
• Payments can be upfront or partial.
• Partial payments for L2D Service are made through each progress update.
- Firstly, the model sketch phase (30%);
- Secondly, the model art phase (30%);
- Finally, the Rigging and delivery phase (40%).
- Totaling 100% in payment.
• The commission will stop progress if an invoice has been neglected or the Client fails to respond to any contact for 7 days.REFUND
• NO REFUNDS will be made after receiving and approving the initial draft.
• If the commission has already been started and is marked as a WIP (Work In Progress), any refund request will be negotiated with regards to the already completed and approved work.
• The commission will be considered closed if the client does not respond after 30 days, and no refund will be issued.REVISION
• Any minor revisions are acceptable.
• Up to two major revisions can be made during the first phase of the commission. Any further major revisions that have been approved prior will be charged an additional fee per revision.DEADLINE
• You reserve the right to set a deadline for your commission. While I reserve the right to take up to 3 weeks to work on your commission, upon complexity, the commission may take 1-2 months max.
• Please bear in mind that I do not have the option and will not accept any request for rushed projects. Only commission me if you can bear the wait, and I promise that although my workflow is slow, I will without doubt, deliver within the set timeframe.
• Clients must respect and consider any complications (such as personal or health issues) if I couldn’t deliver upon the set deadline. And you, as the client, have the right to be notified of any such delays.COMMERCIAL LICENSE
• Will be stated if applicable. List of licenses below:
• Standard Commercial License
- For personal and streaming use only.
- E.g Unmonetized in general. Pfp, banner, panels, general post on social media.
• Custom Branding License
- For personal branding use.
- E.g Monetized content. Thumbnails, covers, and stream assets.
- +50% fee.
• Extended Commercial License
- For business or corporate use.
- E.g Usage for revenue such as promos, sponsorship, and advertisement.
- +80% base fee or TBD.
• Commercial Merch License
- For selling physical or digital goods.
- +100% fee.
• Full Exclusive Rights
- Client has the full rights to use the commissioned work for profit in any way, shape, or form.
- TBD.REMINDER
• ToS is subject to change. These terms may be updated or modified.
• Please note that all of my services are Digital Goods and no physical goods will be shipped to the client.
• I will not work with references created with AI.
• Tracing, modifying, or manipulation of my work is strictly forbidden.
• Any commissioned work is not allowed to be used for NFT or cryptocurrency.
